It seems Samsung might have withdrawn itself by obtaining five significant US carriers to choose almost similar versions of Galaxy S III. But Apple won’t be launching the smartphone evenly as anticipated in US. It is assumed to be taking a twist here.
A request file towards Judge Koh has been issued by Cupertino-based company regarding theban of Samsung’s Android smartphone in US, before it gets shipped in this month-end.
Apple has particularly appealed the judge telling him to make an addition of Galaxy S III to itspresent motion, especially for a prior authoritative order against the Galaxy Nexus. The discussion on this matter is organized for tomorrow.
Apple asserts that Galaxy S III is quite alike the Galaxy Nexus to be tied in the similar motion, and if by chance it acquires its own way out, it need not put forward a new request. Samsung may most probably be obstructed by Apple before the customers obtain its new apps in their hands.
Apple hasn’t made its point clear yet if or not the other two patents [slide to unlock and keyboard suggestions] are also breaching. Apple tells that mostly because of their resemblance, both the handsets can be assessed together.
Samsung reacted, “This process should not be implemented on two days’ notice period and with no genuine record” and “the addition of a new product to this motion would surely make alterations to the assessment of all four preliminary injunction factors.”
Samsung further adds that if Apple has an intention to obtain a prior injunction against Galaxy S III, it should make passage for a different motion, and hence both the parties need more time to review on this proof. Let’s wait and see if Apple’s request gets further approval from judge Koh!
